RIT Privacy Policy
Thank you for visiting our RIT website (the “Site”). Nakoma Products LLC cares about your privacy. This Privacy Policy outlines the type of information collected on this Site from you, how we use that information and protect it, and whether we disclose it to anyone. This Privacy Policy also tells you what to do if you do not want your personal information shared and how you can change information you have already provided to us. All references to “Nakoma Products,” “we,” “us,” and “our” refer to Nakoma Products LLC.

Please review this Privacy Policy before submitting any personal information to Nakoma Products through this Site. You agree that use of the Site signifies your acceptance of this Privacy Policy. If you do not agree with this Privacy Policy, please do not use our Site.

Collection of Personal Information
We collect two types of information from you: (i) information that you knowingly and voluntarily provide to us (e.g. through a registration process, sign-ups or emails); and (ii) information that is derived through automated tracking mechanisms.

In order to fully access the Site, you must complete the registration process and some of this information will identify you personally or enable you to be identified personally, either alone or in combination with other information available to us. This Privacy Policy refers to such information as “personal information.” This may include your name or associated company name, postal address, home or work telephone number, password, email address, credit card information and information used to verify your identity or to avoid fraud. In addition, during the registration process you may knowingly and willingly provide additional personal information, such as, your user name, your website or blog address, photographs, information about your hobbies and interests, your gender, or your birthday. You may also provide us with personal information by using other services. For example, you may link your Facebook or Twitter account to our Site or purchase products through Amazon and this may allow us to obtain information from those accounts (e.g., your friends or contacts). The information we obtain from those services often depends on your computer’s settings or the third party’s privacy policies, so be sure to review all settings and policies.

We may also collect personal information from you about a third party (e.g., a website might allow you to send an electronic “post card” to a friend, in which case we will need that person’s name and e-mail address). Please note that we use such information only for the specified purpose (e.g., to mail the post card) and we will not contact the third party again unless and until the third party contacts us. When you provide us with personal information, you are authorizing us to use that information in accordance with the terms of this Privacy Policy.

Information Collected Using Cookies and Other Web Technologies
Like many websites, our Site may use “cookies” and other similar tracking devices to collect information that is sent to us automatically by your web browser which will help to better tailor our Site and our products to your interests and needs. This information typically includes your IP address, the address of the web page you were visiting when you accessed this Site, the name of your operating system (such as Windows or Macintosh), the name and version of your browser (such as Internet Explorer or Safari), and the date and time of your visit, among other things. The information we receive depends on the settings on your web browser. Please check your browser if you want to learn what information your browser sends or how to change your settings. The information provided by your browser does not identify you personally. We use this non-personal information to measure the effectiveness of our web presence, create statistics that help us improve the Site, and make it more compatible with the technology used by our visitors. If you have created a registration profile during one of your visits to this Site, we may link the information provided by your browser to information that identifies you personally and use it for the purposes described below. In addition, we may review our server logs for security purposes, such as detecting intrusions into our network. If we suspect criminal activity, we might share our server logs — which contain visitors’ IP addresses — with the appropriate investigative authorities who could use that information to trace and identify individuals

How We Use Your Information
When you supply us with your information we will use it for the express purpose for which it was collected (e.g., to enter you in a sweepstakes or to send you a sample). It may also be for any of the following purposes:

  • to communicate with you about products and services which may be of interest to you;
  • to take, process or deliver your order, process or obtain payment, or notify you of the status of your order;
  • to provide you with effective customer service and/or technical support;

  • to assist you with managing your account passwords;
  • for internal marketing analysis such as identification of trends; or
  • to improve the design of our Site.

Sharing Information
We will not disclose, use, or give any personal information to any third parties for any purpose other than to our suppliers and other third parties who we may retain to analyze data we collect, including personal information, to help us improve our products and our Site. In addition, if you order a product or service from us, we may provide personal information to suppliers and other third parties to create the order, process credit card payments, detect and prevent fraud, enable delivery of such product or service, send mail or email or provide customer service. These third parties, including suppliers, are not authorized by us to use your personal information in any other way. Nakoma Products does not sell personal information.

We may supplement the information that you provide to us with other information that we receive from third parties. We do this for marketing purposes in order to provide the most appropriate products and services to meet your needs.

We may transfer, sell or assign your personal information to any entity to which we divest all or a portion of our business (for example, in connection with our sale of a brand), to the extent that you provided such information to the specific portion of our business (or brand) that is being divested, or otherwise in connection with a merger, consolidation, change in control, reorganization or liquidation of all or a portion of our business.

Please note that we will release your personal information if required to do so by law, or by search warrant, subpoena or court order to comply with legal requirements, cooperate with law enforcement, prevent fraud and other crimes, and protect legal rights. There are circumstances in which we may share the personal information in our databases with unrelated third parties. For example, we may disclose the personal information we collect on this Site without notifying you when we, in good faith, believe disclosure is appropriate to comply with the law or a regulatory requirement; to comply with a subpoena or court order; to cooperate with law enforcement or other governmental investigations (without necessarily requiring the law enforcement or government agency requesting the information to formally serve us with a subpoena); to prevent or investigate a possible crime, such as fraud or identity theft; to enforce a contract; to protect the legal rights, property or safety of Nakoma Products, our affiliates, and their employees and agents, other users or the public in general or to protect your vital interests. In addition, we may share specific personal information as disclosed in a specific Privacy Notice posted on the page or area of this Site where you provided that information. You will receive notice when your personally identifiable information might be provided to any third party for any reason other than as set forth in this Privacy Policy, and you will have an opportunity to request that we not share such information.

Please be aware that there are parental control tools available online that can be used to prevent children from submitting information online without parental permission or from accessing material that is harmful to minors. Such third party websites should have their own privacy policy which we recommend you review prior to interacting with such site. At your request and where the law requires us to do so, we will make good faith efforts to confirm what personal information we hold about you, update your information, remove your information, fulfill specific opt-out request, and correct any inaccuracies in such personal information if you let us know by emailing us at info@ritdye.com or following any unsubscribe line in our emails. We may decline to process a request that is unreasonable, jeopardizes the rights of others including rights of privacy, is impractical or for which access is not otherwise required.

Security of Information
We take reasonable precautions to keep your personal information secure. All personally identifiable information is subject to restricted access to prevent unauthorized access, modification or misuse. To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have industry standard measures in place to safeguard and secure information and data we collect through the Site. It is important that you understand, however, that no website or database is completely secure or “hacker proof.” You are responsible for taking personal steps to protect your personal information against unauthorized disclosure or misuse, for example, by protecting your password from unauthorized use or disclosure.
